Role of Legislature in drafting laws in the Transparent and Vibrant India

There’s are three branches of government: The Executive, The Legislative, The Judiciary.
- The Legislative: Makes Laws (Congress, comprised, The House of Representatives and Senate)
- The Executive: Carries out laws (President, Vice President )
- The Judiciary: Evaluates laws (Supreme Court, and others courts)
The power is shared among different organs of government, such as the legislature, executive, and judiciary. This horizontal distribution of power because allows different organs of government placed at the same level to exercise the same power. Such separation ensures that none of the organs can exercise unlimited power. Each organ checks the powers of the other. Judges are appointed by the executive, they can check the functioning of the executive or law made by the legislatures. This arrangement is called a system of checks and balances.
The role of the Legislature is one of the most important instruments of government in organizing society and protecting the citizens of India. It determines amongst others the rights and responsibilities of individuals.
The legislation refers to the preparation and enactment of laws by a legislative body through its law-making process. The legislative process includes evaluating, amending, and voting on proposed laws and is concerned with the words used in the bills to communicate the values, judgments, and purpose of the proposal. Legislative drafting can be defined as the drafting of legislation and of any writing which arises out of the legislation.
Legislation, of course, is the enacted law of the country, the statutes law made by the legislature. The legislature’s most important function is to make laws. The members of the legislature can by a majority vote accept and reject the bills. The members of the Legislature or Parliament enjoy full freedom of speech and also of criticism of the policies of the government. Legislature plays a very important role in India as India has a very huge population, the diversity in India is very vast. So, it’s important for the legislature department for making transparent rules and laws.
There’s are some functions of Legislature:
Law Making:
At this point in time, the most important function of the legislature is making law. Ordinary Bills can be introduced by the members of the parliament and by the Ministers, while Money Bills can be introduced only by the Ministers in the lower house.
Control over the Budgets: Legislature has control over the Budgets process without its approval executive cannot spend any single unit
Control over Executive:
As the legislature makes the law and the executive implement the law. The legislature has control over the executive or the council of ministers. The parliament can remove the Cabinet by a No-confidence Motion. The parliament can appoint a committee to investigate the affairs of the ministers
Judicial:
The Judicial system takes care of the law and gives punishment to those who do not obey the law and do something against the law.
Electoral:
Amendment of the constitution. The legislature has the right to remove Judges. Legislature drafting is done by the legislative department of government and it is legislation that controls and regulates the conduct of citizens. It is said that drafting legislation is an art, not science. It also helps in avoiding litigation and may bring better understanding to the common public.
