International Conference Unbalancing Intellectual Property Law: Maintaining Incentives and Ensuring Access
About the University
Vellore Institute of Technology (VIT) is a private deemed university located in Vellore, Chennai and was founded in 1984. VIT School of Law (VITSOL), the progeny of VIT, entered the legal education arena in 2014.
About the conference
The current global economy is primarily knowledge-based. It is necessary to innovate, create, and disseminate knowledge for handling concerns like eradicating poverty, working with artificial intelligence, addressing climate change, and protecting environmental sustainability. This knowledge constitutes intellectual property (IP) and must be incentivised and protected because it has the potential to become an asset and influence future developments. Intellectual property legislation grants the creator or inventor of IP a monopoly to exercise certain rights over that particular creation for a limited period of time. Once the monopoly period expires, the IP becomes a part of the knowledge reservoir, which everyone can access, use and further develop.
IP law aims primarily to provide an incentive to bring new creations to society, but at the same time, a strong IP law might be prejudicial to the public interest as it will hamper competition, supply, and the price of the product. On the other hand, if the public interest is given more importance, the individual’s interests will be at stake, de-incentivizing them to come up with new ideas and innovations and eventually harming society in the long run. Intellectual property laws ensure that private rights and the public interest are both satisfied. However, this balance lies on a tightrope, and there is a need to interpret these laws to avoid disturbing them. In this backdrop, the conference aims to analyze various forms of Intellectual property Laws in balancing private rights and public interest. The conference aims to provide a platform for Academicians, Advocates, Research Scholars, Law Students, NGO and Policymakers to delve into the issues and solicit their views.
