Central to these concerns is the compatibility of AWS with International Humanitarian Law (IHL), also known as the laws of war. IHL governs the conduct of armed conflicts and aims to limit their effects, especially on civilians and non-combatants. As states and defense industries increasingly experiment with and deploy semi-autonomous and autonomous systems, it is vital to examine whether existing legal frameworks are sufficient to regulate these technologies—or whether new laws are needed.

What Are Autonomous Weapon Systems (AWS)?

  • Automated systems, which operate in pre-programmed, predictable ways (e.g., landmines).
  • Fully autonomous weapons, which interpret data, make decisions, and act without human oversight—often using machine learning.

  • AI-powered drones

  • Automated missile defense systems (e.g., South Korea’s SGR-A1)

Core Principles of International Humanitarian Law (IHL)

IHL is derived from treaties such as the Geneva Conventions of 1949 and their Additional Protocols, as well as customary international law. Its main objectives are to protect civilians and regulate the conduct of hostilities.

Key IHL principles relevant to AWS include:

1. Distinction

Combatants must distinguish between military targets and civilians or civilian objects. Attacks must only be directed at legitimate military objectives.

2. Proportionality

Even if a target is legitimate, the expected harm to civilians must not be excessive in relation to the anticipated military advantage.

3. Precaution

Parties to a conflict must take all feasible precautions to avoid or minimize incidental civilian harm.

4. Accountability

Violations of IHL may constitute war crimes and invoke individual or state responsibility.

Challenges of AWS under IHL

1. Can AWS Distinguish Combatants from Civilians?

The principle of distinction requires nuanced understanding of human behavior and combat environments—something AI still struggles with. Civilians may carry weapons for self-defense, or combatants may wear civilian clothing, creating ambiguity that machines cannot always resolve.

2. Assessing Proportionality

Proportionality assessments involve contextual and moral judgment—weighing civilian risk against military gain. Critics argue that current AI lacks the emotional intelligence, situational awareness, and ethical reasoning required for such evaluations.

In case of unlawful killings or civilian casualties by AWS, it’s unclear who is legally accountable:

  • The programmer?
  • The military commander?
  • The manufacturer?
  • The machine itself?

This “responsibility gap” poses a serious challenge for IHL enforcement.

4. Reliability and Failures

AI systems may malfunction, be hacked, or behave unpredictably in dynamic war zones. This raises concerns about violations without intent, but with devastating consequences.

5. Compliance with Article 36 Weapons Reviews

Article 36 of Additional Protocol I requires states to determine whether new weapons comply with international law. However, there is no global standard for how to conduct such reviews for AWS, and few states publish their methodologies.

There is no dedicated international treaty regulating autonomous weapons. However, AWS must comply with existing IHL obligations, including customary rules and treaty norms.

2. Convention on Certain Conventional Weapons (CCW)

Since 2014, the United Nations Convention on Certain Conventional Weapons (CCW) has held expert meetings on “Lethal Autonomous Weapons Systems (LAWS).” Despite growing concerns, no binding agreement has emerged, largely due to disagreements between states.

Pro-ban countries (e.g., Austria, Brazil, Chile) call for a preventive treaty banning fully autonomous weapons.

Opposing countries (e.g., US, Russia, Israel) argue that existing IHL is sufficient and emphasize potential military advantages.

3. The Role of Soft Law and Norms

In absence of a treaty, international organizations and civil society groups have developed ethical guidelines, including:

  • The ICRC’s position that autonomous weapons must remain under “meaningful human control.”
  • The Campaign to Stop Killer Robots, a coalition advocating for a global prohibition.
  • The UN Secretary-General’s call for a ban on weapons that can kill without human oversight.

Ethical and Human Rights Implications

Apart from IHL, autonomous weapons raise serious ethical and human rights issues:

  • Loss of human dignity: Delegating life-and-death decisions to machines may violate the inherent dignity of human beings.
  • Right to life and due process: Targeted killings without human intervention risk violating Article 6 of the International Covenant on Civil and Political Rights (ICCPR).
  • Moral hazard: Removing human soldiers from the battlefield may lower the threshold for entering armed conflict.

Given the limitations of current IHL in addressing the specific risks posed by AWS, many scholars and states argue for a new international legal framework that:

  • Prohibits fully autonomous lethal weapons that operate without meaningful human control.
  • Requires transparency in the development and deployment of semi-autonomous systems.
  • Mandates accountability mechanisms for misuse or failure.
  • Establishes review and compliance standards, including Article 36 weapons reviews.

Such a framework could take the form of a new protocol under the CCW, a standalone treaty, or binding resolutions from international bodies like the UN Security Council.
