Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has invited Expressions of Interest (EOI) for one Legal Consultant to support its Technical and Legal divisions in litigation, policy, and regulatory work, with online submission on the UP RERA portal open till 27 December 2025.​

Role overview

The Legal Consultant will help strengthen UP RERA’s regulatory framework and oversight over promoters and real estate agents by assisting the Chairman and the Authority on court cases, policy formulation, compliance monitoring, and institutional strengthening. The engagement is on a consultancy basis under the “consultant” category defined in UP RERA’s General Regulations, where consultants are appointed to assist the Authority in discharging its functions under the Real Estate (Regulation and Development) Act, 2016.​

Essential qualification

  • Bachelor’s degree in law (LL.B.) from a reputed university; a five‑year integrated degree is explicitly preferred.​

Experience and skills

  • Minimum 5 years’ professional experience in case-related work before higher courts, with legal research and drafting exposure, preferably in reputed law firms.​
  • Demonstrated experience in handling matters before higher courts, including High Courts and the Supreme Court of India.​
  • Strong legal drafting and research skills, with computer proficiency and knowledge of real estate, consumer protection, regulatory, contractual, and constitutional law.​
  • Proficiency in written and spoken English and Hindi, and the ability to work under strict deadlines.​

The profile clearly targets mid‑career litigators or regulatory lawyers who can blend courtroom experience with policy and regulatory advisory in the real‑estate sector.​

Court case support

The Legal Consultant will be closely involved in UP RERA’s litigation across fora.​

Key tasks include:

  • Assisting the Authority in preparing and sending instructions to its advocates, and in drafting and filing counter-affidavits, supplementary affidavits, appeals, second appeals, writ petitions, SLPs, replies, and responses before the RERA Appellate Tribunal, High Courts, Supreme Court of India, and other forums as required.​
  • Coordinating with standing counsels, senior advocates, and advocates-on-record, promptly briefing them, sending inputs, and updating concerned officers of the Authority.​
  • Tracking cases, maintaining case records (physical and digital), and ensuring timely submission of responses and pleadings.​
  • Immediately bringing interim and final orders of higher courts to the notice of concerned officers with appropriate strategies for compliance, follow up, or challenge as needed.​
  • Assisting the Authority in sending reports and replies to the Government in legally significant matters and in issuing legal notices to promoters and agents.​
  • Conduct in‑depth research on real estate statutes, rules, circulars, regulatory law, consumer matters, constitutional issues, and case precedents from the Supreme Court, High Courts, NCLAT, NCLT, and RERA Appellate Tribunals.​
  • Prepare legal briefs, issue notes, and concept papers on emerging questions within the real‑estate regulatory domain to inform UP RERA’s policy and adjudicatory stance.​

Drafting and vetting of orders and regulations

  • Draft legally sound and well‑reasoned notices and orders in cases and regulatory proceedings before the Authority.​
  • Draft or vet orders, circulars, regulations, guidelines, and internal instructions to ensure compliance with the RERA Act, 2016, Rules, and UP RERA General Regulations.​

UP RERA’s 2019 General Regulations clarify that consultants assist in preparing briefs and summaries of pleadings and in functions delegated by the Chairperson, which aligns with this drafting-heavy mandate.​

Advisory and compliance support

  • Provide sound legal opinions and suggest appropriate approaches on issues arising in the Authority’s functioning, including enforcement, penalties, and interpretation of RERA provisions.​
  • Suggest strategies to strengthen legal compliance by promoters and agents and to minimise litigation risk, supporting institutional strengthening and better consumer protection.​

This requires the consultant to stay current with RERA jurisprudence and related regulatory developments, and to translate them into actionable guidance for UP RERA.​

UP RERA has opted for an Expression of Interest (EOI) route:

  • Mode: EOI must be submitted through the UP RERA web portal; candidates need to use the “Career” or relevant recruitment link on the official website (www.up-rera.in) to access the form.​
  • Last date: On or before 27 December 2025.​

Applicants should be prepared to:

  • Fill in detailed professional information including educational qualifications, bar enrolment (if relevant), practice areas, major matters handled in higher courts, and real‑estate/regulatory work experience.​
  • Upload supporting documents (degree certificates, experience letters, sample orders/briefs, and possibly a short statement of purpose) as required by the portal.​

Shortlisted candidates are likely to be called for interaction/interview, and UP RERA may require them to sign a consultancy contract and performance obligations consistent with its 2019 Regulations and existing consultant templates.​

Ideal candidate profile

The role is ideal for:

  • Litigators with at least five years’ experience in High Court/Supreme Court practice, with a strong track record in regulatory, consumer, or real‑estate disputes and robust drafting skills.​
  • Lawyers from reputed firms or in‑house regulatory teams who are comfortable handling both court work and policy/regulatory drafting, and who can operate bilingually in English and Hindi.​

Given UP RERA’s mandate to enforce transparency, accountability, and timely completion in real‑estate projects, the Legal Consultant will play a critical role at the intersection of litigation strategy, regulatory design, and compliance enforcement.​
