About ICFAI University Tripura

The ICFAI University, Tripura  (referred to hereafter as the University) was established in 2004 through an Act of State Legislature (Tripura Act 8 of 2004). The University has been approved by the University Grants Commission, under Section 2(f) of the UGC Act, 1956. The ICFAI University, Tripura is included in the list of universities maintained by the University Grants Commission (UGC) under Section 2(f) of the UGC Act, 1956, vide their letter No. F.9-7/2006 (CPP-1) dated October 30, 2006.

The University believes in creating and disseminating knowledge and skills in core and frontier areas through innovative educational programs, research, consulting and publishing, and developing a new cadre of citizens with a high level of competence and a deep sense of ethics and commitment to the code of professional conduct.

About The ICFAI Law School

The ICFAI Law School, one of the premier academic wings of The ICFAI University Tripura, is completely ded­ dedicated to the holistic cause of the university in assuring world-class and widest dissemination of legal education and legal research, with a primary focus for North-Eastern India and in pursuance of the valued objectives of the UGC and the Bar Council of India. The school has, over the years, gained a huge trust in the region for its quality education, by making equal efforts for enhancing both the academic as well as professional skills of its law students.

In persuasion of this goal the school, in parallel to its rigorous academic activities, ensures equal participation of students in various other practi­cal and clinical law courses and professional or industrial painting. Out of many such law student placement and professional programs oriented activ­ cities, the ICFAI Law School has a fascination for law students’ active participation in Moot Court Competi­tions, has a dedicated Moot Court Infrastructure, ICFAI Moot Court Committee of Students under the guidance of dedicated faculties. In aid and advice of the university, the ICFAI Law School has a deep thrust for hosting annual National Moot Court Com­ petitions, in addition to its Intra-Moot Competitions, student participation in national moot court competi­tion hosted by other reputed institution of legal edu­cation.

The ICFAI Law School offers five years Full-Time inte­ grated BBA-LL.B (Hons.). BA-LL.B (Hons.) and Three Year LL.B programs with two years LL.M 8 Ph.D. Program with high Academic Standards comparable with those of leading National and International Law Schools in terms of Curriculum, Methodology, Research Oriented internships, and Assignments. The programs are thus designed to impart legal  knowl­edge and professional skills to shape the students as future leaders of the Profession.

Eligibility

All students enrolled in a 3-year LLB program or 5-year integrated B.A./B.B.A.LLB/B. Com LL.B. program shall be eligible to participate in the N.J.Y National Moot Court Competition, 2021.

Structure Of The Competition

The Competition will be structured as per the following format:

  1. Preliminary Rounds
  2. Knock out Rounds
  3. Semi Final Rounds
  4. Final Round

Language

The official language of the competition shall be English. All competition rounds, memorials, and compendiums must be in English.

Team Composition

The team composition shall be as follows: 2 Speakers & 1 Researcher. The teams may not be permitted to participate without a Researcher.

General Information

  • The competition shall be held in virtual mode using Google Meet or Zoom.
  • Oral presentations during the Moot must be made by two speakers, and only two members, from each Team. Researchers shall not be present during oral rounds.
  • Prior to the commencement of the moot session, the Team arguing must indicate which Team Members will act as its first oralist and second oralist and how they wish to allocate the time among (a) its first oralist, (b) its second oralist, and (c) for rebuttal. Time allocated to one oralist cannot be transferred to another oralist. Any Team Member may act as an oralist during any Moot of the Competition and need not always argue the same side.
  • Each oralist may communicate with the judges, and the judges may communicate with that oralist only during his or her allotted time. Only the oral communications with the judges described shall be permitted. In particular, the oralist is not permitted to share his or her screen or present any other text or written materials when the session is progressing. An oralist’s name displayed at the bottom of their screen is permitted.
  • Two Team Members are permitted to stay together in the same court hall. No members of two different Teams are permitted to stay in the same court hall during the session.
  • The oralist while delivering the submission must arrange his or her camera to permit the judges to observe his or her face. All participants and observers of a Moot shall have their microphone muted unless they are making their oral presentation, or specifically asked to speak. Oralists may sit or stand when making their submissions.
  • Where a Team or a Team Member is experiencing any technical problems in joining an Online Moot or when the session is progressing, they must inform the administrator immediately of the problem and the reasons if any which is within their knowledge. Where a technical problem occurs during a Moot the Administrator shall exercise his or her discretion as to how to proceed. Kindly ensure that your device is properly working and you have a stable Internet connection with a Camera and Microphone.
  • Maintaining decorum of the court is mandatory, if any unusual practices found during any round by the participants that team will be directly eliminated from that round and strict actions will be taken against them.
  • Neither audio nor video recording of the whole or any part of an Online Moot is permitted by any Team or Observer. Teams are also barred from disclosing the identity of their institution during the course of proceedings in the Court Rooms. Any disclosure of team identities shall invite penalties including disqualification.

Team Code: Team codes will be provided to each team through electronic mail on 20/12/2021, 20th December 2021.

Memorial Submission

  1. All the teams should submit PDF Version of their Memorial (Both Petitioner and Respondent) to the email address: ilstmcc@gmail.com
  2. The Petitioner’s/ Appellant’s Memorial should have a Blue cover page.
  3. The Respondent’s Memorial should have a Red cover page.
  4. All the memorials should be submitted on or before 16/12/2021 by 11:59PM.

Dresscode

The participants shall adhere to the dress code when presenting any courtroom during the Competition. White shirt, black trousers and black tie along with a black coat and black shoes.

Participation and registration procedure

Teams must register by 10th December 2021/10-12-2021 (11:59 PM) by filling up the google form, including the offline form which the candidates need to download, fill, and submit back along with payment receipts on google form itself.

Memorials

  1. All memorials submitted for purpose of the Competition shall strictly adhere to the rules of the Competition. Each Team participating in the Competition must prepare Memorial on behalf of Petitioner(s), and on behalf of the Respondent(s). Non-compliance in submission of per copy will entail disqualification. Memorials must reach the Organizers latest by 16/12/2021 (16th December 2021), failing which, the same shall not be considered and would lead to disqualification.
  2. Petitioner’s memorials are required to have a Bluecover page and Respondent’s memorials are required to have a Red cover page. The memorials shall not contain any form of identification apart from the team code. If any such identification or mark, symbol, etc. which has the effect of identifying the team is found on the memorial, then it shall result in instant disqualification.

Guidelines Formating

Memorial Structure: The memorial must be submitted in a standard format.

Content Specifications: The following content specifications must be strictly adhered to: i. Font and Size(General)-Times New Roman,12pts, Headings in 14pts, Times New Roman.

  • Page Margins-1inch on all sides
  • The citation should be incompliance with the 20th edition of Bluebook. Speaking foot notes or End notes are not allowed.

Rules For The Preliminary Rounds And Draw Of Lots

The match-up of teams in Preliminary Rounds shall be determined on the basis of the draw of lots. The draw of lots will take place on 21/12/2021, 21st December 2021, and Memorial Exchange shall take place on 21/12/2021, 21st December 2021. The preliminary round would be held on 22nd December 2021

Rules For The Knock Out Rounds And Draw Of Lots

The match-up of teams in Knock out Rounds shall be determined on the basis of the draw of lots. The draw of lots and Memorial Exchange shall take place on 22nt December 2021. The Knock Out rounds will be held on the 23rd of December (23/12/2021)

Knock Out Round

  • The Knock out rounds will be held on 23rd December, 2021. The Knock out rounds shall comprise of single Rounds of oral arguments subject to the allotment of team codes.
  • Each team will get at total of 8 minutes to present their case, and 2 minutes for Rebuttal (Optional)
  • The oral arguments should be confined to the issues presented in the memorial. The researcher may sit with the speakers during the oral rounds. Maximum scores for the oral rounds shall be 100 points for a speaker by a judge. The speakers can provide the copies of the compendium, only if the same is permitted by the panel of judges in the respective courtrooms. No Teams will argue against each other more than once in the Knock out Rounds.
  • The winners of the Knockout rounds shall qualify for the Semi-Final Rounds. For the purposes of qualification from the Knock out Rounds to the Semi-Finals, the number of rounds won by the teams shall be considered as the first criteria. In case there is a tie, the winning difference of their respective rounds shall be taken into consideration. Further, in case of a tie after taking winning scores into consideration, the decision shall be taken on the basis of the Memorial marks.

Semi Final Rounds

The Semi-Final rounds shall comprise Four Teams. The Semi-Final rounds shall take place on 23rd December 2021.The match-up of teams in Semi-Final Rounds shall be determined on the basis of the draw of lots. Each team will get a total of 10 minutes to present their case, and 2 Minutes for rebuttal and sur- rebuttal time (if permitted by the judge(s)).

Final Rounds

The Final Rounds shall also take place on 23rd December 2021. The two teams who stand declared as winners of the Semi-Final Rounds shall qualify for the Final Rounds. Each team will get a total of 20 minutes to present their case, and 7 Minutes for rebuttal and sur-rebuttal time (if permitted by the judge(s)). The Winner of the Final Round shall be declared Winner of the Competition.

General Rules

  • In case of evaluation of all the Rounds, the Memorial Marks shall not be included to decide the merit.
  • The decision of the judges with regard to the outcome of the rounds shall be final.

Scouting

Teams shall not be allowed to observe the orals of another team unless they have been officially knocked out of the competition. Scouting is strictly prohibited. Scouting by any team shall entail instant disqualification.
