About Brainware University

Brainware University Kolkata, a part of a 32-year-old leading education group, Brainware of West Bengal started with the aim of contributing to nation-building through research, innovation, and quality education. It is the brainchild of Mr. Phalguni Mookhopadhayay, its hands-on chancellor, whose acumen and vision have transformed Brainware University into one of the best crucibles.

The Law School of the esteemed University was incepted in the year 2019, the School offers a 5-year B.B.A LL.B Programme & a 3-year LL.B Programme & an LL.M Programme. The first major mooting achievement of the Law School came in the year 2020 with the First batch from B.B.A LL.B qualifying to the semi-finals in the Techno India University National Moot Court Competition & winning the 3rd place runners-up trophy. The School of Law has ever since encouraged students to participate in various competitions.

About AAROHAN, 2021

The Flagship law fest was organized by the Brainware University – School of Law. The Fest is organized through the cooperation of 3 committees of the School of Law, namely – the Moot Court Committee, The Debate Committee & the Event Management Committee. The Fest strives to bring together esteemed academic institutions by means of participation in the grand competitions, through budding camaraderie among students as well as academicians along with networking opportunities with eminent personalities in numerous professions. The Fest shall comprise of two competitions, namely – Justice Sabyasachi Mukharji Memorial National Moot Court Competition, 2021 in collaboration with Economic Laws Practice – Advocates & Solicitors & Justice P. N. Bhagwati Memorial National Debate Competition, 2021.

Aarohan is Sanskrit for Ascent or Ascension. Aarohan is the reality of life which signifies the growth of one’s self – a journey towards Legal Excellence & signifies evolution. Excellence in terms of legal acumen, argumentation skills, &
research skills.

Important Dates

  • The Last Date for Registration is on 5th of November, 2021
  • The Moot Proposition & the Debate Topic shall be released on 7th of November, 2021(The wide theme of the Proposition shall be Commercial Law.)
  • The Inauguration & Preliminary Rounds will be on 19th of December, 2021
  • The Semi Finals & Finals will be on 20th of December, 2021

  • The Registration Fee is Rs. 900 /- for each team for both the competitions.

About Justice P. N. Bhagwati Memorial National Debate Competition, 2021

In memoriam of Late Hon’ble Chief Justice of India Mr. P. N. Bhagwati, Brainware University – School of Law Debate Committee under the umbrella of the law fest titled AAROHAN is organizing the Justice P. N. Bhagwati Memorial National Debate Competition, 2021 with aims of promoting & nurturing camaraderie among students of different callings & to enable them to excel in the skills of research & argumentation.

Hon’ble Justice Prafullachandra Natwarlal Bhagwati, the 17th Chief Justice of India – a much-celebrated man for his contributions in various forms, among which are the introduction of the Public Interest Litigation & the concept of Absolute Liability. Hon’ble Mr. Bhagwati began his career practicing at the Bombay High Court. In July 1960, he was appointed a judge of the Gujarat High Court. In September 1967, he was appointed the Chief Justice of that court. On two occasions, he acted temporarily as Governor of Gujarat (7 December 1967 to 25 December 1967 and 17 March 1973 to 3 April 1973. In July 1973, he was appointed a Judge of the Supreme Court of India. In August 1985, he became Chief Justice of India. He is held, along with Justice V. R. Krishna Iyer, to have pioneered judicial activism in the country. In 2007, Hon’ble Mr. Bhagwati was awarded the Padma Vibhushan in public affairs, India’s second highest civilian award.

Rules & Regulations for the Debate Competition

Article 1. Team Composition

  1. The teams shall be composed of minimum 2 members & maximum 3 members in a team (Third member shall be the researcher).
  2. Inter academic institution team ups are not allowed.

Article 2. Topic(s)

  1. There shall be a separate topic for the preliminary rounds.
  2. The topic for the semi-final rounds & final rounds shall be the same.
  3. A team shall speak either in favor or against the topic.
  4. A submission should be made by the teams either for or against their topic(s).

Article 3. Time Allotment

  1. Each team shall speak for 15 minutes, subject to division within the speakers.
  2. 3 Minutes shall be reserved for rebuttals for each team.

Article 4. Questioning by the Judges

  1. Judges can ask questions to any member of any team if they deem fit to do so.

Article 5. Attire

  1. The attire for the participants must be formal.
    • T-shirts, Jeans, Caps are not allowed.

Article 6. Negative Marking

  1. There may be negative marking for a team in case they do not complete their speech within time

Article 7. Gains outside of established procedure

  1. Any gains outside of the established procedure(s) shall be disallowed.

Article 8. Fixtures

  1. The number of matches shall be decided by the Debate Committee.
  2. The Matchups shall be decided by the Debate Committee.

Article 10. Submission Guidelines

  1. The participants are required to submit a Debate Memorial containing –
    • Introduction of the Topic
    • Description of the Main content of the Topic
    • Relevance vis-a-vis the National & International Circumstances
    • Opinion of the Team
  2. The Language of the Debate Memorial must be lucid & unambiguous
  3. Copying from other documents & using ornamental words is not desirable.
  4. The Debate Memorial is introduced to encourage students to write pursuant to their own intuition & understanding
  5. The Submission should be made in both .pdf & .docx
  6. The Submission should be made at sa.law@brainwareuniversity.ac.in

Article 11. Formatting Guidelines

  1. Font: Times New Roman
  2. Line Spacing: 1.5 for Body & Headings, 1.0 for Footnotes
  3. Font Size: 10 (Footnotes), 12 (Body), 14 (Headings), 16(Title)
  4. Footnoting Style: Bluebook 20th Edition

Article 12. Miscellaneous

  1. The Debate Committee reserves the rights to add or omit rules mentioned above or to modify them for the smooth processing of debate competition, but that will be intimated to the team within reasonable time.
  2. In case of any discrepancy, the decision of the debate committee will be final.
